Customer Remediation - Rescheduled Payment Fee Refund Program

Sunshine Loans is committed to making things right. We sincerely apologise to customers who were affected by a fee that should not have been charged. We are refunding all affected customers and paying interest on those amounts.

This page explains what happened, what we are doing about it, and how to contact us if you have questions.

What happened

Between November 2013 and November 2020, Sunshine Loans charged a fee called a "Rescheduled payment fee" or "Amendment fee" under its Small Amount Credit Contracts. Sunshine Loans stopped charging the fee on 2 November 2020.

In April 2024, the Federal Court of Australia found that this fee was not permitted under the National Credit Code.

Sunshine Loans accepts this finding and has taken steps to refund all affected customers.

Who is affected

You may be affected if you were charged a "Rescheduled payment fee" or "Amendment fee" at any time between 4 November 2013 and 2 November 2020.

Approximately 7,590 customers were charged this fee across approximately 9,894 transactions. The standard fee was $35 per transaction.

What we have done

Sunshine Loans began refunding affected customers in June 2024. We have:


refunded the full amount of the fee for each transaction - even where the fee was only partially paid;

paid interest on refunded amounts at the RBA cash rate plus 6% per annum, compounded monthly, from the date the fee was first charged to 30 June 2026; and

contacted customers whose initial refunds failed by SMS, email to obtain updated bank details; and

extended the program to include all customers charged the fee from November 2013 to July 2016, which is the period the fee was charged before the period covered by the Court proceedings.

As at 19 August 2026, the significant majority of affected customers have been successfully refunded.

What you need to do

If you have already received your refund and interest payment:

You do not need to do anything.

If you have received a letter or communication from us asking for your bank details:

Please provide your updated bank account details using the contact information below so we can process your refund.

If you recall being charged a Rescheduled payment fee or Amendment fee on a Sunshine Loans loan but have not received a refund or heard from us:

Please contact us using the details below and we will check our records.

Unclaimed money

Where we have been unable to contact a customer despite reasonable efforts, we will remit the outstanding refund and interest to the Queensland Public Trustee. Customers who have not yet provided updated bank details have until 30 September 2026 to do so. After that date, any outstanding amounts will be forwarded to the Queensland Public Trustee. Your money will remain available for you to claim at any time.

Payments to registered charities

For customers from the period prior to July 2016, individual records are no longer available to allow us to identify and contact those customers directly. Where we cannot identify or contact a customer despite reasonable efforts, we are required to pay the outstanding amounts to a charity or not-for-profit organisation registered with the Australian Charities and Not-for-profits Commission (ACNC). Those amounts cover both the refund of the fee and the interest component.

If you think you may have been charged a Rescheduled payment fee or Amendment fee on a Sunshine Loans Small Amount Credit Contract before July 2016 and have not heard from us, please contact us using the details below. To assist us to investigate, please provide a copy of any account statement or other record showing the fee was charged.

How to make a complaint

If you are not satisfied with your remediation outcome or have concerns about the process, you can:

Beware of scams

Please be aware of scams. Sunshine Loans will never:


• ask you to send us your online banking password or PIN;

• ask you to transfer money to another account to keep it safe; or

send you an unexpected payment and ask you to return part of it.

If you receive a suspicious communication claiming to be from Sunshine Loans, please contact us directly using the details above before taking any action.

Updates

This page will be updated as the remediation program progresses. The next update will follow the processing of outstanding interest payments and the remittance of unclaimed amounts to the Queensland Public Trustee, expected to occur by 31 October 2026.
