The Promotion Terms and Conditions are constituted by the below: 

▪️Schedule of Details (Schedule); and 

▪️Terms and Conditions of Entry. 

Entry into the Promotion is deemed acceptance of the Promotion Terms and Conditions. 

SCHEDULE OF DETAILS 

TERMS AND CONDITIONS OF ENTRY 

Unless otherwise stated: 

▪️capitalised terms used in these Terms and Conditions of Entry have the meaning given in the Schedule. 

▪️a reference to Terms and Conditions is a reference to the Promotion Terms and Conditions, comprised of the Schedule and these Terms and Conditions of Entry. 

1. Eligibility to Enter 

1.1. Entry to the Promotion is open to Eligible Persons as described in the Schedule. 

2. Entry into the Promotion 

2.1. To enter the Promotion, entrants must complete the Entry Procedure during the Promotion Period. 

2.2. Entries submitted and received by the Promoter outside of the Promotion Period will not be accepted. The time of entry will in each case be the time which the online entry is received by the Promoter's database, not the time of transmission by the entrant 

2.3. Entries may only be submitted in accordance with the Entry Procedure and will not be accepted by the Promoter in any other form. Computer generated or other automated entries will not be accepted. 

2.4. All valid entries received during the Promotion Period will be entered in the Prize Draw. 

2.5. Once submitted, an entrant cannot alter or delete their entry. 

2.6. Entries must be received by the Promoter during the Promotion Period. Email and electronic entries are deemed to have been received at the time of receipt into the Promoter's database and not at the time of transmission by the entrant. 

2.7. No entry fee is charged by the Promoter to enter the Promotion. As the Promotion involves entry via a website, the cost of accessing the website will be dependent on the entrant's Internet service provider. 

3. Entry content and validity 

3.1. Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these Terms and Conditions. 

3.2. Incomplete, indecipherable or incomprehensible entries will be deemed invalid. Entries that breach these Terms and Conditions (including the content guidelines at cl 4.1 below) will also be deemed invalid. 

3.3. Entries submitted by persons who are not Eligible Persons will be deemed invalid and discarded. The Promoter may not assess each entry however, winning entries will be scrutinised. 

3.4. If for any reason, the Promoter becomes aware after an entrant has won a prize and the entrant has not complied with these Terms and Conditions or that their entry is otherwise invalid, that entrant will have no entitlement to the Prize, even if the Promoter has announced them as a winner and that entrant will be required, at the direction of the Promoter, to return, refund or otherwise make restitution of the Prize. 

4. Consents and Permissions 

4.1. An entrant's entry must not include any content that: 

(a) contravenes any law, infringes any third-party rights (such as intellectual property rights), is false, misleading, deceptive or inaccurate; 

(b) contains any computer viruses, worms or other potentially damaging computer programs or files; 

(c) s obscene, offensive, potentially defamatory, discriminatory, threatening, harassing, hateful, indecent or otherwise objectionable or inappropriate (including but not limited to, any content involving malice, excessive violence or swearing); 

4.2. By entering the Promotion, the entrant warrants to the Promoter that: 

(a) they are an Eligible Person and the sole author and owner of the intellectual property rights in their entry; 

(b) all content submitted as part of their entry is true and accurate and that use of the content they submit as part of their entry does not violate these Terms and Conditions and will not cause injury to any person or organisation; and 

(c) their submitted entry is the original opinion of the entrant and does not contain any material which would infringe the rights of any third party, including any copyright, trademark or other third-party intellectual property rights.  

4.3. The entrant agrees to indemnify the Promoter and keep the Promoter indemnified against all costs and claims by third parties arising from a breach of the warranties set out in this clause. 

4.2. By entering the Promotion, the entrant: 

(a) voluntarily waives all "moral rights" that they may have in such content or entry;  

(b) consents to the Promoter using their entry (or any part of it) in accordance with the Entry Condition in the Schedule; and 

(c) grants the Promoter a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute all content submitted as part of their entry and/or incorporate such content into any form, medium or technology throughout the world without compensation to them. This includes the right of the Promoter to republish any feedback provided on the Promoter's Facebook page, Instagram account or any other social media platform or in any digital or promotional communications. 

5. Determining and Notifying Winners and delivering Prizes 

5.1. The Prize Draw will be conducted in accordance with the Draw Details in the Schedule. The Prizes will be awarded to the valid entries randomly drawn, in accordance with the Prize Details in the Schedule. 

5.2. Winners will be notified and their Prizes delivered by email, as specified in the Winner Notification in the Schedule. 

6. Claiming Prizes 

6.1. Prizes will be deemed "claimed" and "unclaimed" in accordance with Claimed and Unclaimed Prizes in the Schedule. 

6.2. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and an entrant's details (including an entrant's identity, age and place of residence). In the event that a Winner cannot provide suitable proof as required by the Promoter to validate their entry, the Winner will forfeit the prize in whole and no substitute will be offered. 

6.3. Prior to sending the Prize, the Promoter may require a Winner to provide identification such as proof of identity, age or residency. In the case that a Prize winner cannot verify their identity, age or residency, they will forfeit their right to the Prize. Identification considered suitable for verification is at the Promoter's discretion. 

7. Prizes - General 

7.1. Prizes are not transferable or exchangeable and cannot be redeemed for cash. No compensation will be paid if a Winner is unable to use the Prize. 

7.2. If a Prize or any element of a Prize is unavailable for any reason, the Promoter may substitute for that Prize, or an element of that Prize, another item of equal or higher value as determined by the Promoter (at its absolute discretion). 

7.3. Without limiting the above, the Promoter may at its absolute discretion, substitute cash for any Prize (the amount of cash being equal to the prize value specified in the Prize Details). 

7.4. Where a Prize is lost, stolen, damaged or tampered with, for reasons beyond the control of the Promoter, the Promoter is not liable. 

8. Privacy and Information 

8.1. Entrants' personal information may be used for the purposes described in Entry Condition and Use of Personal Information in the Schedule.  

8.2. The Promoter may disclose entrants' personal information for those purposes to other companies associated with the Promotion, related bodies corporate of the Promoter, the Promoter's information technology providers and database service providers, or other entities which provide research or marketing services to the Promoter. 

8.3. Winners' names will be published and retained as required under relevant legislation.  

8.4. Entrants' personal information will otherwise be handled in accordance with the Promoter's privacy policy, available at https://sunshineloans.com.au/privacy-policy/. 

8.5. Entrants may access, change and/or update their personal information and obtain a copy of the Promoter's privacy policy by contacting the Promoter via email at sunshine@sunshineloans.com.au or phone at (07) 5526 8866. 

8.6. By entering the Promotion, entrants acknowledge that they have read and understood how their information will be used and disclosed by the Promoter. 

9. Limitation of Liability 

9.1. To the extent permitted by law, the Promoter (including its officers, employees and agents) will not be responsible for any acts of god, acts of terrorism or war (declared or undeclared), state of emergency, disaster, technical failures, security breaches, tampering, unauthorised intervention, fraud, computer viruses or other events beyond the Promoter's control which affect the proper or reasonably anticipated conduct or administration of the Promotion, or prevent the awarding of the Prize in accordance with these Terms and Conditions. If such an event occurs, the Promoter may at its absolute discretion cancel, terminate, modify or suspend the Promotion, invalidate any affected entries, or suspend or modify any Prize, subject to any written directions from a relevant regulatory authority.

9.2. The Promoter and its associated agencies and companies (including their officers, employees and agents) will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 

10. General 

10.1 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and may, at its absolute discretion, disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. 

10.2. The Promoter may at its absolute discretion prohibit an entrant's participation in the Promotion, cancel or suspend a Prize or cease to provide any Prize to a winner if the entrant or Winner is, in the reasonable opinion of the Promoter, behaving aggressively, disruptively, or in a manner which may diminish the goodwill or reputation of the Promoter, or are engaging in conduct that is misleading, deceptive, contrary to law or is otherwise inappropriate. 

10.3. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 

10.4. The Promoter's decisions in connection with the Promotion are final and no correspondence will be entered into. 

10.5. The Promoter accepts no responsibility for any tax implications that may arise from acceptance of the Prize. Entrants should seek independent financial advice prior to entering the Promotion if this is a concern. 

10.6. No responsibility will be taken for unsuitable, lost, deleted, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
